Mediation Services

 

Commercial Disputes. Ms. Hobbs has recently mediated many real estate disputes between buyers and sellers of property involving interpretation of the real estate purchase contract, changes to the contract and the wrongful lien statute.  She has also mediated many disputes between general contractors, subcontractors and buyers and sellers of real estate.  Ms. Hobbs also  mediated claims regarding purchase and sale of vehicles, including breach of contract, defective construction and disputes regarding service on the vehicle warranties.   
Personal Injury Ms. Hobbs has recently mediated several cases involving medical malpractice.  Ms. Hobbs has mediated multi-party cases involving multiple vehicles.    In one case, the case was resolved using blind offers.  
Business Valuation  Ms. Hobbs has mediated multiple complex business valuation issues involving several forensic accountants in both commercial and family related cases.
Employment Ms. Hobbs has mediated a variety of employment disputes involving employment discrimination, sexual harassment and wrongful termination.  In one case, mediation involved more than 25 parties and required on-going follow-up calls to facilitate resolution of the complex dispute. 

Probate An increasing number of probate/guardianship/conservatorship matters are now mediated due to the district court rules requiring mediation in contested probate cases.  Ms. Hobbs assisted the courts in creating the probate mediation program in Utah and has recently mediated many probate lawsuits involving motions to remove the personal representative and resolution of the assets in the estate.  

Co-Mediation Practice. Ms. Hobbs has mediated over 3,200 of disputes in a wide range of cases.  Her mediation is currently expanding to include co-mediation with Hon. William B. Bohling and Joe Epstein in complex multi-party cases including catastrophic injury, probate, construction defect litigation. 

Appellate Mediation Due to her four years as an appellate mediator and ten years as an attorney for the appellate courts, Ms. Hobbs has privately mediated appellate disputes.  Her former role as Chief Appellate Mediator make her uniquely qualified to mediate appellate cases due to her understanding of the appellate process, the standard of appellate review, and the risks involved in appellate decisions.
